The Chief Minister of Uttarakhand, Harish Rawat has to get vote of confidence from the Legislative Assembly due to being sacked. However, the other seven Congress MLAs who were suspended cannot participate in the voting process. So, on this issue, a special bench was made with Justices Dipak Misra and Shiva Kirti Singh.
A two hour long session will be held between 11 a.m to 1p.m. During these two hours, the President’s Rule will be kept in abeyance. The bench decided that the two Congress MLAs cannot participate because, if the MLAs are having the same status of being sacked, then their participation is of no use.
Significantly, the MLAs’ plea against the disqualification is pending before the Uttarakhand High Court which is likely to hear the matter tomorrow. The bech of judges said that, “His (Sundaram) submission is that the disqualified Members should be allowed to vote, though their votes may not be counted as long as the disqualification remains. This Court cannot direct them to participate in the Assembly. We say no more on this score.”
Overall Nine MLAs have been disqualified by the speaker. The floor test would be conducted under the supervision of the court, as per the bench.
